Well... a few weeks ago.. I had to get my TV repaired.. so its fixed, and they brought it back to me today. Two weeks ago.. I bought the Xbox 360 Elite version. I think you guys know where this is heading. The guy knocked the 360 off of my dresser.. on to my hard wood floor. Its broken, circuit city told me too bad, even though this is the TV repair company they had arranged to fix my TV. I bought the warranty.. but it doesn't cover "dropping the console". Needless to say, if this TV repair places insurance company doesn't cover it... Lawsuit here I come..

That's horrible! Definitely go for it...they are responsible for the destruction of your property, and you should be compensated with a replacement at the very least.

The guy called the company and told him right in front of my parents.. I was not home at the time.. its a good thing.. cause I would have flipped. And if they try to lie their way out of it.. I'll kick some ass.

The TV company is the one who broke it (unless the TV company and Circuit City are connected, then they're both at fault). You have better luck suing the company that actually destroyed your property, than suing the company that just won't replace it for you.

I'd wait to see if they try to resolve the issue prior to starting a lawsuit. A lawyer, or judge for that matter, might consider it frivilous. Small claims court, I guess, would be the best avenue if it goes that route. I hope it doesn't.

Thats why I said I was going to wait to see what they said before I did that. Anyway, Full Reimbursement as long as I provide the receipt, which I have.

Thats a valid lawsuit if it comes to that. Destruction of private property....I'd sue too...it's your stuff and they damaged (ruined) it. They need to make it right...it's not like you are asking for them to replace it AND give you $50,000. You just want to be made whole. That's what courts are for.
